PRB Rules – Texas Administrative Code

Proposals are rules that have been approved by the board to be published in the Texas Register for public comment. The public comment period usually lasts for 30 days after the publication date. After the public comment period has closed, staff evaluates all comments and makes appropriate changes to the proposed rule for consideration by the board.

Rule adoptions are rules that have been adopted by the board and republished as final in the Texas Register. They usually become effective 20 days after the PRB files them with the Texas Register for publication.
Adoptions will remain on this page for 30 days after the effective date.
The PRB currently has no open or recent rule adoptions.
Section 2001.039, Texas Government Code directs each state agency to review and consider for readoption each of its rules every four years. During the review, the PRB must assess whether the reasons for adopting each of its rules continue to exist.
The board must vote at a public meeting to publish notice of the intent to review specific rules in the Texas Register. The notice of intent to review rules includes a 30-day public comment period. After the time for public comment has passed, the board will take one of the following actions regarding each rule: readopt, readopt with changes, or repeal the rule.
If the board readopts a rule, notice of the readoption will appear in the Review of Agency Rules section of the Texas Register, but the text of the readopted rule will not be published. Any proposed repeal of or proposed amendment to a rule will be published in the Proposed Rules section of the Texas Register in accordance with procedures set out in Chapter 2001, Subchapter B, of the Texas Government Code, and will be the subject of an additional 30-day public comment period before final repeal or final adoption.
Once a notice of intent to review specific rules has been published in the Texas Register, the board will post on its website a link to the published notice.
